AbstractIn this research with its address "The Duties and Rights in Islamic Sharee'a compared with the Palestinian Work Law" the duties and rights to the worker in both Islamic Sharee'a and the Palestinian Work Law.
I begin it by defining the duty from the Sharee'a and language scientists point of view, and showing the concept of the right lingnisti cally and Idiomatically, also as the law scientists defrint it, after that defring the labor from the share,a scientists point of view.
In this research there is discussion about the legality of rent decument and the FiKh adjusts to the labor job with defring the Two sorts employe: the special and the common employers with their defferences ,after that this research talks about the Islamic look at work and workers in the field of agriculture and commerce and other aspects.
Showing how Islam encourages and rewards the worker for away from looking and his job. the research discusses the duhes of Labours Sharee'a and the Palestinian work law. These duties are finishing the work well ,watching the worker how he fullfil the work himself , being in the work fild, Keeping the work tools safely, and implemining honestly the orders of the work owner with in the limita that the Islamic sharee,a and the Law prove.
In this research also there is the morals duties which is related to the good will intention. Such as not to say the work secrets to any one , and the necessary of dealing the agents of the work owner in agood way. also in the research you can find the neccassary of using the means of healthy and safety that available in the work held.then the moral rights to the Labour as the role of the state to find work opporitunities to the workers and the humanitarian look to the Labour, and to encourage the labour and reward him.From the work owner, the research talks about the bad effects for permithing the child to work.the research talk about the rights to the Labour to do his worships law his salary from Islamic Sharee,a and law point of view in palestin in evey single details.
In the research then is adiscussion about the work leares and their different kinds the insurance in Islamic Sharee'a, the worker right to be compensated if he exposed to dangers ,the worker rights of finishing the job after lony years and hoe this can be solred from both Sharee,a and Palestine laws. Retirement ,complaining against the work owner, demonstating and stor working also the research talks also about the worker's in versions and how can be in vested from it.
